How does an accused killer flee the United States?

FAIRFAX COUNTY, Va. (7News) — Fairfax County Commonwealth’s Attorney Steve Descano’s office gave the green light to an alleged killer to go to Washington, D.C. and get a passport at his home country’s embassy.

Next, Abdulloi Toshpulodzoda boarded a flight at Washington Dulles International Airport to his home country of Tajikistan.

In 2019, Toshpulodzoda was charged with murdering a man in Fairfax County.

When police arrived at the scene, the officers said Toshpulodzoda had blood all over his body, and he admitted to stabbing a man to death.

But in 2022, he was found not guilty by reason of insanity for second-degree murder, and he was committed to the custody of the Commissioner of the Department of Behavioral Health and Development Services.

A September 2025 document from the Virginia Department of Behavioral Health said he was a candidate for conditional release.

According to court documents, U.S. Immigration and Customs Enforcement had issued an immigration detainer for his arrest.

Sean Kennedy is a victim’s rights advocate who says Descano and the State failed the victim and the victim’s family.

“How does an accused killer get a day pass to get a passport?” Nick Minock asked.

“The law in Virginia allows the psychiatrist, the same ones who are pushing for his release, to escort him to the courthouse and to issue these without a judge’s ruling,” said Kennedy. “The passport was issued at the behest of the prosecutors. They asked that he go and get a passport. Why would an accused killer who’s mentally insane need a passport? He’s being indefinitely incarcerated by the state. Why does he need a passport? The judge, the prosecutor, even his own defense counsel crossed the line in allowing that. And the psychiatrists were totally derelict in their duty to help him do it.”

7News reached out to Descano and asked why his office allowed him to get a passport.

Descano’s office said it’s true that prosecutors did not oppose him taking an escorted visit to get his passport. But Descano’s office said prosecutors opposed his release and that he should remain in state custody.

A bench warrant has now been issued for Toshpulodzoda’s arrest.
