A three-judge panel of the U.S. Court of Appeals for the D.C. Circuit denied the Trump administration’s motion to immediately lift a lower court’s stay on ending TPS. The judges wrote that the administration did not meet the legal standard to stay that lower court order, “particularly given that the case will be returned to this court on July 27, 2026.”
Once TPS ends, those without another status will be at risk of being detained and put into removal proceedings in immigration court. Each individual’s case has unique circumstances and everyone has legal rights to present their case.
In a joint status report filed in the D.C. district court on Friday, July 10, lawyers representing the Haitian plaintiffs said they believe the court will not have jurisdiction over the case until that mandate. They said they are considering filing an amended complaint, planning to inform the court by Friday, July 31.
That complaint will likely focus more on racial animus plaintiffs it said was used in the determination to end the status for Haiti.
U.S. Citizenship and Immigration Services in the past few weeks has announced two temporary extensions on expiration dates for employment authorization documents for TPS holders while waiting for district courts to issue orders in line with the Supreme Court’s decision. The most recent order extends employment authorization through at least Friday, July 24.
Many Springfield Haitians have work permits based on something other than TPS, such as a pending asylum application.
