The defence in the ongoing Petrojam fraud trial outlined two new issues in their no case submission in the Kingston and St. Andrew Parish Court on Monday.
They argued that these new developments should exonerate former Petrojam Chairman, Dr. Perceval Bahado-Singh, and former general manager, Floyd Grindley.
The pair are on trial on charges of conspiracy to defraud, fraudulent conversion, aiding and abetting fraudulent conversion and obtaining valuable security by false pretence contrary to the provision of the Larceny Act.
Shaloy Smikle was in court.
On Monday, attorney representing Dr. Bahado-Singh, Bert Samuels, continued his no case submission with two main issues.
A no case submission is made when the defendant asks the court for an acquittal without him or her having to present a defence.
In the first issue, Mr. Samuels cited a particular board meeting which he says the prosecution claimed was led by the former Petrojam bosses.
Mr. Samuels explained that the meeting did not happen.
He spoke with our news centre following Monday’s hearing.
Mr. Samuels also made mention of a previous email trail, which he says was initially redacted by the prosecution.
He explained that the full email thread was evidently clear that certain key words had nothing to do with overseas trips by Dr. Bahado-Singh.
Instead, he says the email thread was referring to a state meeting to which the company was invited.
In response to the first issue, the prosecution had asserted that Dr. Bahado-Singh claimed and received reimbursement for both board meetings, but only attended one.
The defence and prosecution both agreed to have the matter continue on Wednesday morning at 10.
