An Angola man who was involved in a crash that killed an eight-year-old boy last weekend has been arraigned on a slew of charges. Acting Erie County District Attorney Michael Keane says 52-year-old Markus Genovese, who was arraigned Monday afternoon while hospitalized at ECMC, has been charged with a Class C felony count of 1st-degree vehicular manslaughter, Class D felony counts of 2nd-degree vehicular manslaughter and leaving the scene of an incident resulting in death, a Class E felony count of 1st-degree aggravated unlicensed operation, 3rd-degree assault, DWI, DWAI-drugs or alcohol, speeding, driving without a license, drinking alcohol or using cannabis in a motor vehicle on a highway, and being a pedestrian on a prohibited area of a highway.
The fatal crash occurred Saturday evening at the intersection of Route 5 and North Creek Road in the Town of Hamburg, where Genovese’s pickup truck rear-ended an SUV that was stopped to make a left turn. After the crash, Genovese allegedly abandoned his vehicle and ran from the scene. He was located in the nearby woods a short time later by responding officers and transported by ambulance to ECMC. Eight-year-old Thomas Ross of Blasdell was fatally injured, while a four-year-old boy was treated at Oishei Children’s Hospital in Buffalo and released.
Genovese, who is being held without bail, is scheduled to appear in Hamburg Town Court for a felony hearing on Thursday. If convicted of the highest charge, Genovese faces a maximum sentence of 15 years in state prison.
